1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of SetStreak at setstreak.com and its web application (the "Service"), operated by Nexint ("SetStreak", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use SetStreak, and you must be able to form a binding contract. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements.

3. The Service

SetStreak is a workout tracking tool. It lets you follow and customize a workout plan, log sets, weights, reps, and cardio, and track goals, streaks, and personal records, with your data synced to your account across devices. SetStreak is currently provided free of charge. We may add, change, or introduce paid features in the future; if we do, we will make any applicable terms clear before you are charged.

4. Your account

• You need an account to use SetStreak, and you must provide a valid email address.
• You are responsible for safeguarding your password and for all activity that occurs under your account. Use a strong, unique password.
• Notify us promptly at support@setstreak.com if you suspect unauthorized use of your account.
• Accounts are for individual use — one account per person. Do not share your account or impersonate anyone else.

5. Acceptable use

You agree not to:

• access, tamper with, or use other users' accounts or data;
• disrupt, overload, or attempt to gain unauthorized access to the Service, its servers, or related systems;
• probe, scan, or test the vulnerability of the Service except as expressly authorized by us;
• use automated means (bots, scrapers) to access the Service in a way that burdens our infrastructure or circumvents protections such as rate limits;
• reverse engineer or attempt to extract source code, except to the extent this restriction is prohibited by applicable law;
• use the Service to store or transmit unlawful, infringing, or harmful content; or
• use the Service for any purpose that is illegal or that violates these Terms.

6. Your content

Your workout data is yours. You retain all rights to the content you create in SetStreak. You grant us a limited, non-exclusive license to host, store, process, and display that content solely for the purpose of operating and providing the Service to you (for example, storing your workouts and syncing them back to your devices). This license ends when you delete the content or your account, subject to the retention described in our Privacy Policy. You are responsible for the content you enter and for ensuring you have the right to use it.

7. Health and safety — not medical advice

SetStreak is a logging and tracking tool. It is not a substitute for professional medical advice, diagnosis, treatment, or personal coaching, and it does not provide medical or fitness recommendations tailored to you. The default plan and any templates are general information only, not a prescription.

Exercise carries inherent risks. Consult a qualified healthcare professional before beginning any exercise program, especially if you have a medical condition, are pregnant, or are unsure whether an activity is appropriate for you. You assume full responsibility for your training decisions, train within your own limits, and stop if you feel unwell. To the fullest extent permitted by law, SetStreak is not responsible for any injury, health condition, or loss arising from your use of the Service or any activity you undertake based on information logged in it.

8. Intellectual property

The Service, including its software, design, branding, name, logo, and content we provide (excluding your content), is owned by SetStreak and Nexint and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as permitted by law.

9. Availability and changes

SetStreak is under active development and is provided on an "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that data will never be lost, and we recommend you keep your own records of important information. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice.

10. Termination

You may stop using SetStreak at any time and may request deletion of your account as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms, if required by law, or if necessary to protect the Service or other users. Provisions that by their nature should survive termination (including content licenses you have granted, ownership, disclaimers, limitations of liability, and dispute terms) will survive.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements or that any defects will be corrected.

12. Limitation of liability

To the fullest extent permitted by law, SetStreak, Nexint, and their affiliates and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. In no event will our total aggregate liability for all claims relating to the Service exceed the greater of the amount you paid us for the Service in the twelve months before the claim (which, for a free account, is zero) or fifty U.S. dollars (USD $50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless SetStreak and Nexint from any claims, damages, losses, and reasonable expenses arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-laws principles. You agree that the state and federal courts located in Texas will have exclusive jurisdiction over any dispute that is not otherwise subject to an alternative resolution process, except where prohibited by applicable law. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

15. Changes to these terms

We may update these Terms as the Service evolves. When we do, we will revise the "Last updated" date at the top of this page, and for material changes we will take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.
